A) The Attack on Non-Competes and the Status of Other Restrictive Covenants

This presentation is extremely timely given the uncertain future of non-compete agreements which have been under growing attack. In recent years, several states have enacted legislation to narrow the scope of enforceable non-competes. More recently in 2023, the FTC proposed an almost categorical ban on non-competes, then Congress reintroduced a Bill to do the same. In this session, the speakers will address the key provisions and impact of the FTC’s proposed ban and the key provisions of the Workforce Mobility Act. The speakers will also discuss practical steps employers can take in light of the proposed rule and Workforce Mobility Act. They will also address the enforce ability of other restrictive covenants such as non-solicitation agreements and NDAs.
